Welcome to Thoughts Made Real ("we," "our," "us","Perfeked"). These Terms of Service ("Terms") govern your access to and use of our website, Thoughtsmadereal.ca (the "Site"), and any purchases you make from us.
By accessing our Site and purchasing our products, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Site.
Artwork Description: All paintings, prints, sculptures, and other items ("Artwork") are original creations or limited edition reproductions by ThoughtsMadeReal. We strive to display the colors and details of our Artwork as accurately as possible. However, due to variations in monitor calibrations and lighting, we cannot guarantee that your screen's display of any color will be perfectly accurate.
Availability: All orders are subject to availability. We reserve the right to discontinue any product at any time. In the event that an item is out of stock after you place an order, we will notify you and issue a full refund for that item.
Custom & Commissioned Work: Separate terms and a specific agreement will be provided for custom or commissioned artwork. Those terms will supersede these general Terms for that specific project.
Order Acceptance: Your order constitutes an offer to purchase Artwork. We reserve the right to accept or decline your order for any reason, including but not limited to the availability of the Artwork, errors in the product or pricing information, or suspected fraud.
Pricing: All prices are listed in CAD. We reserve the right to change prices at any time without notice. Shipping and handling costs will be added to your total and displayed before you complete your purchase.
Payment: We accept payment through our designated third-party processors (e.g., Stripe, PayPal). You agree to provide current, complete, and accurate purchase and account information for all purchases.
Processing Time: Custom or framed items may require a longer processing time, which will be communicated at the time of purchase.
Shipping: Shipping costs and estimated delivery times are provided at checkout. You are responsible for providing a correct shipping address. We are not liable for packages lost or stolen after delivery confirmation is provided by the carrier.
International Orders & Customs: International customers are responsible for any customs, duties, taxes, or fees levied by their country. We cannot predict or be responsible for these charges.
Our Rights: All content on this Site, including but not limited to images, text, logos, designs, and the Artwork itself, is the intellectual property of Thoughts Made Real and/or the respective artists. It is protected by copyright, trademark, and other laws.
Your License: When you purchase a physical piece of Artwork, you own the physical object. You do not own the copyright to the artwork. This means you may not reproduce, distribute, create derivative works, or use the image for commercial purposes without our express written permission.
You agree not to use the Site for any unlawful purpose or in any way that could damage the Site or impair anyone else's use of it.
The Site and all Artwork are provided on an "as is" and "as available" basis without any warranties of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied.
In no event shall Thoughts Made Real, its owners, or artists be liable for any indirect, incidental, or consequential damages arising out of your use of the Site or the Artwork.
You agree to indemnify and hold harmless Thoughts Made Real and its owners from any claim or demand, including reasonable attorneys' fees, made by any third party due to your breach of these Terms or your violation of any law or the rights of a third party.
We reserve the right to update or modify these Terms at any time without prior notice. The "Last Updated" date at the top of this page will indicate when changes were made. Your continued use of the Site after any change means you accept the new Terms.
These Terms shall be governed by and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law provisions.
